Aircraft Technical Requirements Impacting Transferability

The rapidly developing network of regulation relating to aircraft technical requirements should take into account the practicalities of cross-border transferability of aircraft. AWG established a subgroup whose purpose is to engage in policy discussion to advance that core principle.

The AWG formed a subgroup on aircraft technical requirements, focusing on regulations related to cross-border transferability of aircraft. The specific purpose of that subgroup is:

(i) to serve as a vehicle through which the international aviation financing community can influence international regulations with a view towards enhancing efficiency and safety in the placement and redeployment of aircraft; and 

(ii) to work with the aviation regulatory community on harmonising regulations and/or procedures that will enhance safety, and on improving the efficiency of aircraft airworthiness certification, as aircraft are transitioned from one jurisdiction to another. 

Economic Impact Assessment

AWG has commissioned an economic impact assessment to determine the costs of  duplicative and overlapping regulations relating to cross-border transferability.  That study is being undertaken by SGI Aviation, and will be completed over the coming period.  Once completed, the study will be posted here and otherwise made available to policy makers.

First Phase : EU – US Bilateral Aviation Safety Agreement

As an early outcome of its consultations with FAA and EASA and in response to the recent entry into force of the new EASA basic regulation, EC No 216/2008, AWG developed a position paper outlining the items that it believes should be addressed as the international regulatory frameworks impacting cross-border transferability develop.  The paper makes specific observations relating to that regulation as well as to its implementing rules on airworthiness certification of aircraft, EC No 1702/2003, and on continuing airworthiness certification, EC No 2042/2003.
 

Current organization of work :

The subgroup now operates through Project Teams that concentrate on a specific aspect of rulemaking and transferability requirements and report to the subgroup as a whoe.

AWG Proposal to Establish an ICAO International Registry for Transferability Requirements

The AWG Technical Requirements subgroup recently prepared an overview document of the current status of cross-border aircraft transferability based on data relating to regulations in force. The documents can be consulted here.  It is designed, in part, to support the AWG initiative to promote the establishment of the International Registry for Aircraft Transferability Requirements encouraging National Aviation Authorities to publish their aircraft importation requirements.  Once such a registry is established, AWG foresees that timely access to such data and its general transparency will assist in efficient transferability.  Over time, it may also lead to the development of international norms and standards.

AWG considers that ICAO is uniquely positioned to provide this global informational framework which would, over time, promote harmonization among national aviation authority requirements.  ICAO is also uniquely positioned to serve as an informational nerve center providing timely accessibility and clarity to the international transfer, operation, maintenance and repair of aircraft.  Indeed, AWG believes that this role for ICAO speaks essentially to its mandate as it would complement and build upon Annexes 6 (operation of aircraft) and 8 (airworthiness of aircraft) of the Chicago Convention.
